1. Acceptance of these general conditions
Any use or visualization of the services provided by the Site (hereinafter referred to as the “Services”) presupposes that the user (hereinafter “the User”) has expressly read and accepted these General Conditions (hereinafter the “ CG ”), the Privacy Policy and the Cookie Policy, which are therefore fully enforceable against it.
The User's commitment is effective by checking the box "I have read and accept the General Conditions and I confirm my order".
No order can be taken into account in the event of refusal of these GTC.
These GTC constitute a contract between the User and the Company.
Any access to or use of the Site is at the risk of the User. To consult this Site, you must necessarily be of legal age under the applicable regulations, in your place of residence, to consume alcohol.
The Company reserves the right, at any time, to modify all or part of these GTC.
Therefore, Users are invited to regularly consult the GTC in order to be aware of the latest updates.
Any modification replaces and cancels the previous stipulations.
The entry into force of the modified T & Cs will be effective from their posting online and will therefore apply as of right.
The use of the Services subsequent to any modifications made to the T & Cs will constitute acceptance by the Users of the latter as modified.
2. Ordering
2.1 The buyer (hereinafter "the Buyer") has the possibility for each order (hereinafter the "Order") to create a personal account, to connect to his pre-existing account or to proceed through a so-called “instantaneous” command.
It is the Buyer's responsibility to first check the content of his Order. He will then be directed to a secure page in order to proceed to the payment of the Order.
The sale is only complete upon verification of the Order, after the Buyer has communicated all the information necessary for payment and the payment has been accepted.
The Order will then be confirmed by the Company by sending an email.
2.2 The information provided by the Purchaser when placing an Order is binding on the latter.
If all or part of the delivery addresses prove to be incorrect, requiring Château Virant to repatriate the Order, the Buyer may request reshipment, at his expense, after payment for the latter or cancel his Order and request a refund, except for transport costs.
Château Virant cannot be held responsible for any impossibility in which it may be to deliver the product (s) ordered (hereinafter referred to as the "Product").
2.3 The Company reserves the right to refuse, reduce or split all or part of an Order if the quantity ordered or the frequency of its orders seems abnormal to it.
The Company also reserves the right to suspend, cancel or refuse any Order from a Buyer with whom there is a dispute relating to the payment of a previous order, until full payment of the latter.
2.4 All offers are subject to the limit of available stock and the Company therefore reserves the right to apply restrictions on the desired quantities.
In the event that the ordered wine is out of stock, Château Virant will inform the Buyer as soon as possible in order to offer a replacement product or a refund.
The Company cannot be held liable in the event of unavailability of an ordered Product. In the event of partial unavailability, the Company alone may decide to split the Order, or to send the Products to the Purchaser only when all the Products are available, while advising the Buyer of the chosen option.
In the event of a refund request by the Purchaser, the Company will reimburse the sums paid with the same means of payment as that used for the Order, within 14 (fourteen) days of the refund request.
2.5 Orders can be honored, depending on the producer, for the shipment of 1 to 120 bottles. However, taking into account transport constraints, the minimum quantities are specific to each product and as specified on the product sheets.
3. Large Quantity Orders
As part of the sale to individuals or professionals for large quantities (over 120 bottles), an estimate is established and sent by email. It is valid for a period of fifteen (15) days from the date of its sending by email, unless otherwise stipulated in the estimate. If the Purchaser accepts the estimate, it must be returned within the aforementioned period by email to Château Virant. This document must include the handwritten mention "read and approved", the first and last name of the authorized person, the appropriate signature, and the date. For a company, its administrative stamp must be affixed.
The Buyer will receive confirmation of his Order by email.
4. Price
The price is expressed in Euro.
The price indicated on the product sheets available online does not include transport.
The price of the products indicated in the order summary by clicking on the "basket" tab is the final price, expressed inclusive of all taxes and including the VAT applicable on the day of the order, as well as handling and packaging costs.
To this price, must be added the transport costs applicable on the day of the order, the latter being the responsibility of the Purchaser. The costs are estimated at the time of each Order and indicated, in the Order summary, below on the line “Shipping costs”.
5. Payment
Payment must be made in full during the Order, as collection of payment.
The payment method used on the www.chateauvirant.com site is secure payment by credit card or Paypal, at the Buyer's choice, at the time of confirmation of the order.
Orders that are not paid in this way are not recorded by the site's order manager.
6. Delivery
6.1 Delivery costs are the responsibility of the Purchaser, unless otherwise specified.
6.2 Château Virant undertakes to do everything in its power to deliver the Products ordered as quickly as possible.
When the request is dispatched, the Buyer, if he selects delivery to a Mondial Relay point, receives an email including a link allowing tracking of the package.
6.3 As far as possible, Château Virant offers the Buyer at least two possible delivery methods (one at home, one at a relay point or other). However, Château Virant reserves the right to choose the mode of transport, in order to ensure delivery under the best conditions.
Receipt of the Products is confirmed by the signature of a delivery slip or equivalent and by the delivery of the Product to the recipient by the carrier.
It is up to the Purchaser upon receipt of his package to check the wines received to ensure their full compliance with the Order. In the event of delivery of non-compliant or damaged bottles of wine, the Purchaser will have the option of refusing the delivery, subject to mentioning this on the delivery slip given to him by the carrier.
Products accepted without reservation are deemed to have arrived in good condition and in their entirety.
6.4 Any delays do not entitle the Purchaser to claim damages or penalties for delay.
Any delay in delivery due to circumstances beyond the control of the Company may not result in the cancellation of the order.
7. Cancelled Orders and Refunds
Pursuant to Articles L.221-18 et seq. Of the Consumer Code, the Buyer has a period of 14 (fourteen) days from receipt of the Products to proceed with the total or partial return of the Order.
To exercise the right of withdrawal, the Purchaser must notify, before the expiry of the withdrawal period, his decision to withdraw by means of an unambiguous declaration sent to the Company.
The Buyer then has a maximum period of 14 (fourteen) days to return the Product (s) from the date of dispatch of his withdrawal request, to the following address :

In the event of withdrawal, the Company undertakes to reimburse the Buyer for all payments received, including delivery costs, no later than fourteen days from the day on which it was informed of the decision to withdraw.
The reimbursement may however be deferred until receipt of the returned Products.
The return costs remain the responsibility of the Purchaser.
Returned Products must be in the exact state of receipt (unopened bottles, corks and labels intact), undamaged, and accompanied by a copy of the corresponding Château Virant invoice.
8. Guarantees against hidden defects
The Products benefit from the legal guarantee against hidden defects, in accordance with articles 1641 and following of the Civil Code.
It is however noted that, despite all the attention that Château Virant pays to its Products, wine is a living and fragile product and must be stored in suitable conditions (temperature, humidity, etc.).
9. Presentation of the Products
The characteristics of the Products offered for sale are described on the Château Virant Website. The photographs do not enter into the contractual field and in no way engage the responsibility of the Company. A change in labeling does not constitute a modification of the characteristics of the Product.
The Product's technical sheet is the only source of contractual information.
10. Taxes : Excise duties, Ecotax & VAT
For some EU countries or third countries, excise duties on “still wines” and “sparkling or sparkling wines” are levied by their respective tax administrations. The same is true for the ecotax in force in Belgium. These taxes are paid to the administrations concerned. These taxes are included in the catalog prices (of the destination country).
The Company invites Users to consult a legal or tax advisor, the only one authorized to provide advice in this area; Users' attention is drawn to the risks associated with a subsequent modification of the applicable tax legislation.
11. Legal information
11.1 Ordinance n ° 59-107 of January 7, 1959, law n ° 74-631 of July 5, 1974 as well as article L.3342-1 of the Public Health Code prohibit the sale and offer of drinks alcoholic beverages to minors and the like.
Consequently, any person placing an Order on the Site or wishing to subscribe to the opening of an Account on the Site undertakes and declares to be eighteen (18) years of age.
The Company declines all responsibility for the application of and compliance with regulations other than French law.
11.2 In view of the completion of the distance sale, the Purchaser expressly accepts and acknowledges renouncing the benefit of article 1587 of the Civil Code.
11.3 The abuse of alcohol is dangerous for health. Know how to consume and enjoy it in moderation.
11.4 If any part of the T & Cs should prove to be illegal, invalid or unenforceable for any reason whatsoever, the term or terms in question will be declared non-existent and the remaining terms will retain all their force and scope and continue to be applicable. The terms declared non-existent will be replaced by terms which come closest to the content of the canceled clause.
In the event of a contradiction between a foreign language version of these GTC and the French version, the latter will prevail.
12. Personal data and confidentiality
The User is informed that the personal data transmitted through this Site may be recorded for the time strictly necessary in a file in order to be able to respond to any requests and to be able to ensure the proper functioning of the Site and of Service. This information will be managed and kept in complete confidentiality by the Site for the time necessary to process the request.
All the information relating to the storage of this personal data (nature of the data collected, retention period, user rights, etc.) can be consulted in the Privacy Policy accessible HERE.
13. Disputes
These GTC are governed by French law.
Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in those who take the trouble to explain their situations.
In the event of a dispute, the Purchaser is invited to find an amicable agreement by contacting Château Virant.
Otherwise, the dispute will be brought before the competent courts.
